By accessing or using the website at theparcmn.com, our mobile application, or any services provided by The PARC ("The PARC," "we," "our," or "us"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use our website, app, or services. We reserve the right to update these terms at any time, and your continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to use our website and services independently. Individuals between 13 and 17 may use our facility and services with the written consent and supervision of a parent or legal guardian. Children under 13 are not permitted to use our website or create accounts.

3. Account Terms

When you create an account through our website or WellnessLiving platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and current information
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others
• Not create multiple accounts for the purpose of abuse or circumventing policies

4. Memberships & Payments

Membership fees are charged according to the plan you select. By providing payment information, you authorize The PARC to charge the applicable fees on a recurring basis until cancellation. All fees are non-refundable except as stated in our cancellation policy.

Membership cancellations require 30 days written notice. Drop-in fees, class packs, and purchased passes are non-refundable once used. We reserve the right to change pricing with 30 days advance notice to active members.

5. Facility Rules & Code of Conduct

When using our facility, you agree to:

• Follow all posted facility rules and staff instructions
• Treat staff, instructors, and fellow members with respect
• Use all equipment properly and as intended
• Wipe down equipment after use
• Wear appropriate attire for the activity
• Not use the facility while under the influence of drugs or alcohol
• Not engage in harassment, intimidation, or disruptive behavior

The PARC reserves the right to suspend or terminate access for any member who violates these rules.

6. Assumption of Risk & Waiver

You acknowledge that physical exercise, sauna use, cold plunge immersion, contrast therapy, and other wellness activities involve inherent risks of injury. By using our facilities and services, you voluntarily assume all risks associated with these activities.

You agree to consult a physician before beginning any fitness or recovery program, especially if you have cardiovascular conditions, are pregnant, or have other health concerns. You agree to disclose any medical conditions to our staff that may affect your safety when using our services.

7. Limitation of Liability

To the fullest extent permitted by Minnesota law, The PARC, its owners, employees, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, application, facilities, or services. Our total liability for any claim shall not exceed the amount you paid to The PARC in the 12 months preceding the event giving rise to the claim.

8. Intellectual Property

All content on this website, including but not limited to text, images, logos, graphics, videos, and design elements, is the property of The PARC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this site without our prior written consent.

9. Termination

We may suspend or terminate your access to our website, app, and services at any time, with or without cause and with or without notice, for conduct that we believe violates these Terms of Use, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use our services will cease immediately.

10. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Anoka County, Minnesota.
